Terms of Service
Agreement
These Terms of Service are an agreement between you and ViralView operator for access to and use of ViralView. By using ViralView, you agree to these Terms. If you use ViralView for a company, client, or other organization, you represent that you have authority to bind that organization.
ViralView is an invitation-only social analytics and reporting service for business use.
Accounts and team access
- You must provide accurate account information and keep access to your email, magic links, devices, and sessions secure.
- Team owners and admins are responsible for the users, recipients, account handles, and interest sets they add.
- You must promptly remove access for people who should no longer use the service.
- ViralView may suspend or terminate access if we believe an account is unauthorized, unsafe, inactive, or violates these Terms.
Acceptable use
- Do not use ViralView for unlawful, harmful, misleading, abusive, harassing, discriminatory, or infringing activity.
- Do not attempt to bypass security controls, access another team's workspace, scrape ViralView, overload the service, reverse engineer non-public parts of the service, or interfere with service operation.
- Do not use ViralView to collect or process information in a way that violates law, platform terms, privacy rights, intellectual property rights, or your agreements with clients or third parties.
- Do not submit credentials, secrets, payment card data, sensitive government identifiers, or other highly sensitive personal information unless ViralView explicitly supports that data type.
Customer responsibilities
- You are responsible for the TikTok handles, hashtags, interest sets, report recipients, and instructions you provide.
- You must have the rights and permissions needed to monitor selected accounts, send reports to recipients, use exported insights, and act on ViralView outputs.
- You are responsible for independently reviewing reports, recommendations, predictions, summaries, and creative briefs before relying on them or publishing related content.
Third-party platforms and public data
ViralView uses public TikTok-related information and third-party providers such as TikAPI or similar services. ViralView is not affiliated with, endorsed by, or sponsored by TikTok.
Third-party data may be incomplete, delayed, inaccurate, unavailable, rate-limited, changed, removed, or subject to third-party terms. ViralView is not responsible for third-party services or platform changes.
Reports, analytics, and AI features
ViralView reports, dashboards, strategy opportunities, predictions, similarity scores, AI-assisted summaries, and creative briefs are informational business tools. They are not legal, financial, advertising compliance, investment, or professional advice.
AI-assisted outputs can be inaccurate, incomplete, or unsuitable for your use case. You are responsible for human review and final decisions.
Fees and commercial terms
ViralView access is currently invitation-only. Any fees, payment timing, taxes, renewals, cancellations, usage limits, or service levels are governed by a separate order, invoice, plan, or written agreement. If there is a conflict, the separate commercial terms control for that commercial topic.
Ownership and license
ViralView and its software, design, workflows, models, reports templates, documentation, and related materials are owned by ViralView or its licensors. You retain ownership of business information you submit, subject to the rights you grant us to provide, secure, support, and improve the service.
You may use ViralView outputs for your internal business purposes and client work, subject to these Terms and any separate commercial terms.
Confidentiality and privacy
Each party should use reasonable care to protect non-public information received through the service or business relationship. ViralView's handling of personal information is described in the Privacy Policy.
Disclaimers
To the maximum extent permitted by law, ViralView is provided as-is and as-available, without warranties of any kind. ViralView does not guarantee uninterrupted access, error-free operation, continued third-party data access, report delivery, AI feature availability, or that outputs will meet your requirements.
Limitation of liability
To the maximum extent permitted by law, ViralView and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or business interruption. ViralView's total liability for claims relating to the service will not exceed the amounts paid for the service during the three months before the event giving rise to the claim, or 100 USD if no fees were paid.
Indemnity
You will defend, indemnify, and hold harmless ViralView and its operator from claims, losses, liabilities, damages, costs, and expenses arising from your use of the service, your submitted information, your violation of these Terms, or your violation of law or third-party rights.
Changes, termination, and governing law
We may update these Terms from time to time by posting an updated version on this page. We may change, suspend, or discontinue parts of ViralView at any time.
